# Regulacion del acceso a la interrupcion voluntaria del embarazo y a la atencion postaborto - ley 27610 -. Derogacion (5172-D-2023)

> "2024 - YEAR OF THE DEFENSE OF LIFE, FREEDOM, AND PROPERTY" BILL The Senate and Chamber of Deputies enact with the force of law REPEAL OF LAW 27610 ARTICLE 1. - Law 27610 on Voluntary Interruption of Pregnancy (IVE) is repealed. ARTICLE 2 - Article 85 of the National Penal Code is modified and will be worded as follows: "ARTICLE 85. - Whoever causes an abortion shall be punished: 1. With imprisonment for three (3) to ten (10) years, if done without the woman's consent. This penalty may be increased to fifteen (15) years if the act results in the death of the woman. 2. With imprisonment for one (1) to four (4) years, if done with the woman's consent. The maximum penalty shall be increased to six (6) years if the act results in the death of the woman." ARTICLE 3 - Article 85 BIS of the National Penal Code is repealed. ARTICLE 4 - Article 86 of the National Penal Code is modified and will be worded as follows: "ARTICLE 86. - Doctors, surgeons, midwives, or pharmacists who abuse their knowledge or skills to cause or assist in causing an abortion shall incur the penalties established in Article 85 and shall also suffer special disqualification for a period twice as long as the sentence. An abortion caused by a qualified doctor with the consent of the pregnant woman and with the purpose of avoiding an imminent danger to the life of the mother is not punishable, provided that the danger cannot be avoided by other means." ARTÍCULO 5° - Modificase el art. 88 del Código Penal de la Nación, el que quedará redactado de la siguiente manera: "ARTÍCULO 88. - Será reprimida con prisión de uno (1) a tres (3) años, la mujer que causare su propio aborto o consintiere en que otro se lo causare. La tentativa de la mujer no es punible. El juez podrá disponer que se exceptúe de la pena a la mujer en atención a los motivos que la impulsaron a cometer el delito, su actitud posterior, y la naturaleza del hecho." ARTÍCULO 6° - Comuníquese al Poder Ejecutivo.
